		<description>Your comment about linking to copyrighted material being legal since &quot;That is just the way the Web works&quot; is just plain wrong.

Let&#039;s assume your bank stupidly publishes an API that lets anybody create a link such that each time someone clicks it a hundred dollars is deducted from your bank account. If somebody does click the link, is it not stealing? You would probably sue your bank, but I suspect you would also want to go after anybody who did use the link. Most people would call such use of the link stealing. Similarly, you certainly can create a link to somebody&#039;s copyrighted content, but that act *by itself* does not grant that person legal access to content to which you do not own the rights.

Copyright law is not about what is physically possible; it&#039;s about what&#039;s legally defined. Just because you can physically point a gun at someone and pull the trigger doesn&#039;t mean you can ignore the legal concept of &quot;murder&quot;.

If you want to justify linking to someone&#039;s copyrighted material, you had better base your argument on existing copyright law. You seem to be arguing that by putting something on the web somebody gives up the right on how it is accessed. That&#039;s not an unreasonable argument, but it needs to be based on existing copyright law. Saying it&#039;s legal just because you can do it is an emotional argument without any legal validity.</description>

Unless they would fine (outrageously) a very few as an example, which I find unacceptable.
In a moment in which the copyrights life is on stake, it is simply ridiculous to propose to criminalize linking.
It is not only useless, but even dangerous to make laws you are sure you won’t be able to oblige people to follow.
You could start the thought that when a crime is committed by millions becomes a habit...

		<description>Erick Schonfeld, you missed the scariest part.  Judge Posner wants it to be illegal to &lt;i&gt;paraphrase&lt;/i&gt; anything under copyright, without the copyright holder&#039;s express permission.  That means talk about what someone else said in our own words.

Can you imagine having to submit a written request to the New York Times Company to be able to talk about anything anyone said on the Times site?  

Judge Posner, I just paraphrased you.  So did Erick Schonfeld.  So are you going to order TechCrunch to take down this post?
