
As far as I can tell, the Associated Press is sticking by its ridiculous and unlawful assertion that “direct quotations, even short ones” are copyright infringements and result in lawsuit threats and DMCA takedown notices.
This story led us to ban the A.P., call the New York Times out on undisclosed conflicts of interest and begin to investigate some ridiculous organization called the Media Bloggers Association before getting bored and wandering off to other topics.
But now the A.P. has gone too far. They’ve quoted twenty-two words from one of our posts, in clear violation of their warped interpretation of copyright law. The offending quote, from this post, is here (I’m suspending my A.P. ban to report on this important story).
Am I being ridiculous? Absolutely. But the point is to illustrate that the A.P. is taking an absurd and indefensible position, too. So I’ve called my lawyers (really) and have asked them to deliver a DMCA takedown demand to the A.P. And I will also be sending them a bill for $12.50 with that letter, which is exactly what the A.P. would have charged me if I published a 22 word quote from one of their articles.
Next time, A.P., ask permission before you quote me. I work hard to create content, and it just isn’t appropriate for you to simply cut and paste it into your own product and then sell that to others.

The AP is so completely & utterly WRONG on this issue, that I find their whole position somewhat baffling.

It is ironic for the AP to attempt such strict enforcement of copyrights against blogs given that traditional news media have themselves become so dependent upon blogs as news sources.
Actually, very short quotes tend to be less protected under copyright law (at least in the U.S.), so the AP may be on shaky ground here. A stronger argument in favor of the AP is that copying hot news is protect against under the law. Yet the AP seems to give license to such copying of hot news by allowing its news to be paraphrased. As Arrington suggested, the line drawn in the sand by the AP regarding quotes may come back to haunt it.

Well I think the old press is just on the verge of being supplanted by the blogosphere. I find more info that is not AP than is. As others have noted much of their material is originated elsewhere. I regularly am quoted by local media but have yet to have them link to me. I’m still a bit too small.. But it is representative of the big media to attempt to continue to marginalize the blogs even though they are regularly ‘clipping” our work without attribution.
I think you are just pulling peoples chains on the MBA now Mike. It is pretty apparent they are just trying to help out Rogers Cadenhead from Drudge Retort at his request. Not speak for the entire blogosphere.

I was about to say what Jackson said. You’re actually helping support their absurd position. Plus, TechCrunch should operate at a much higher standard than the AP. For example, the AP doesn’t link to the original bloggers who discover stories; you do.
The AP may be unethical, but you can show the journalists how to live up to blogger standards through example…

There may be an opportunity for a class action lawsuit. I’ve been quoted by the AP on at least one occasion and have not been compensated for the original content (5-25 words) they “stole” from me when they printed the quote.
