Google's orkut was a good service, but now it has got one of the largest collection of porn in the world.(not based on studies but on basic search queries.)

Based on IT laws in India hosting these contents are illegal.

Although I would like to see Indian laws amended so that "obscene speech" is also included within the ambit of "free speech", but till then this man should have been careful. There is always a civilized way of hating somebody. Writing vulgar messages is not always the best thing to do! It is not 'hate' that had him arrested, bu rather the words he chose to express his hate.

And people thinking the need to liberate India, seriously need a good sleep. India is already a free country. Idiots!

1. This act of the Indian police has placed India among the closeted medieval socities of the world, from the largest democracy that it is known as.

In a country where nonsense about freedom of speech is pom-pomed about but not practiced, this is a glaring example which demonstrates that you cannot speak your mind against a powerful person in India, much like you cannot speak against tyrannical dictatrships of the middle-east, Africa or communist totalitarion regimes like those of China.

2. No Indian law supports this. This is a lie that the police were following the law. They are merely using their powers to abuse the rights of a citizen. The judiciary will soon dismiss the case. Then the case of Google having abetted the breaking of law will come to the fore.

The arguments I have heard supporting Google's actions are:

1. "Law of the land" argument - This is should be called the "slippery slope" argument and it is a common fallacy. The argument suggests, I think foolishly, that google had to support India's request because it is the law. One must follow the law unquestionably or there will be anarchy. This, of course, is not true. Google could have denied handing over the guy's ip address and that would have been the end of it. Perhaps at the absolute extreme there would be a boycott of all of Google's products placed by the Hindu government. There would not be anarchy, but google would take a huge loss on the booming market there.

2. "Who are we (america) to judge other cultures" argument - Americans, this argument suggests, have no right to judge another culture or to refuse to obey another culture's wishes. At first glance, this argument makes sense. Other cultures do things different then us, so it is obvious we should not intrude on their customs. However, when an American company goes in to foreign land, that company, in the view of the american public, has an obligation to uphold their country's basic rights. Also, under international law there are basic freedom such as freedom of religion, press, and art which are applied to all countries. As long as the "foreign" culture upholds these basic freedoms, I can recognize this argument as valid. Unfortunately, Google violated the person's freedom here.

3. Corporations are not morally responsible for their actions abroad - This argument is the weakest of them all. Another way of saying this is: Corporations are by default immoral entities that can only be controlled through local laws. It is obvious that corporations have responsibilities for their actions. Claiming that anyone, let alone a billion dollar company, has no responsibilities for their actions is begging for corruption and totalitarianism.

4. There are worse evils argument - While there are worse and far more sinister companies and governments who commit larger violations of freedoms, the criticism google will receive is still well justified. Especially since their company's slogan is "do no evil." Google is a hypocrite.

Change the following :
-----------
Today we’re hearing of another arrest, this time in India. 22-year-old IT professional Rahul Krishnakumar Vaid. His crime was writing in an orkut community named “I hate Sonia Gandhi.” Sonia Gandhi is a prominent politician in India.
-----------

The link from Sonia Gandhi goes to http://en.wikipedia.org/wiki/Sonia_Gandh - which is incorrect (typo in link). Furthermore, Ghand is a vulgur word in hindi, I think.

You don't want to be the next person arrested :P

Google's aggressiveness and eagerness to comply with Indian authorities should also be noted here. Not only have they removed the offending post (which is probably required by the draconian IT act of India), but they've also gone ahead and removed the "I hate Sonia Gandhi" community on Orkut. I doubt this was required by law.

To many Americans, what is evil?

It is easy to see their narrow mind: God bless America, and un-American is evil.

all internet companies (particularly ones as powerful as Google) should be Swiss (or emulate their foreign policy and banking stances).. they understand the need for absolute privacy and strictly enforced neutrality. if anything, this to me is an issue of "Net Neutrality" even if the term has come to mean something else. This basic human right of expression, particularly on the web, should be enshrined in every democratic constitution going forward. Very sad to be of Indian ancestry today.
