		<description>jesus, this is news? ash and zod filed this patent eleven years ago, i recall chuckling when i was told they were patenting my.yahoo, which i believe they did only as a defensive measure (to prevent someone else from doing so and trying to take yahoo to court). as far as i know, no one at yahoo has tried to beat anyone into submission with this patent, so why the hemming and hawing? yippee, crunchgear knows how to search patents. don&#039;t worry, netvibes will still be there in the morning.</description>

It should also be noted that even if such customization were accomplished in a (slightly) different manner(s), under the Doctrine of Equivalents (DoE), if the “result” is the same/virtually the same as Yahoo’s method/system, others could still be found to be infringing.

This certainly points out–again–the importance of IP protection in the age of the Internet…a painful lesson Digg’s Mr. Rose is no doubt feeling as others copy his content aggregation and ranking system/s.

While it&#039;s true that there are oh so many junk biz-method/software patents out there; due in large part to both current and in-the-past time and production pressed patent examiners operating with insufficient non-patent prior art data bases and search tools (along with many patent applicants who have disingenuously/illegally ignored and/or failed to even search for and disclose such non-patent prior art in their filings); this Yahoo patent looks to be one of the (very) good ones...</description>

This suggests to me that Excite was not processed in real time, but a published system. Again .. that was a long time ago, and time plays tricks with the memory.

There was very little, if any, practice of this kind of technology at that time.  Zip2 was the first company I recall having a personalized page generator.  I don&#039;t recall specificaly when they launched it, but it was 97/98 timeframe.  At that time, this was a pretty innovative, if not exactly unique, idea.

Jojo: Yahoo may have no interest in extracting license fees.  It is rarely a winning strategy to use patents offensively.  Most often, patents are used to prevent someone else from filing suit against you for technology you invented.

That being said, I agree that reform is needed in the patent system.  With the pace of innovation online, the patent office is woefully unprepared to address the realities of our business environment.  Note that this patent took almost 8 years to be processed.  By the time most patents are issued in this space, the practice in question has either gone the way of the dodo or has become common practice.

But Yahoo may be able to extract some license $$ from smaller companies that they know don&#039;t have the resources to fight a patent battle.  I doubt Yahoo will go after a Google sized company if they choose to try and enforce this.</description>
